Court mandates consideration of net income when determining alimony

Case: Tanner v. Tanner, 1st DCA (July 1, 2021)

Ruling: “In determining the amount of an alimony award, section 61.08(2), Florida Statutes, requires a trial court to consider, among other factors, the parties’ financial resources. Florida courts have consistently concluded that this section mandates a consideration of the parties’ net incomes, not gross incomes.”

Comment: Remember, the payor spouse is paying taxes, social security, and Medicare on their gross income so trying to equalize income is not equal mathematically.
